Terms of Service

By accessing or using Wenkendi, you agree to these Terms of Service. If you do not agree, please do not use the platform.

1. The platform

Wenkendi provides fundraising technology and payment processing tools that allow users to create campaigns, share their stories, and receive voluntary donations. Wenkendi is not a broker, financial institution, charity, or creditor.

2. Eligibility & age requirement

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account, start a campaign, or make a donation. Users under 18 may only use Wenkendi with verifiable parental or legal-guardian permission where expressly permitted by applicable law, and the parent or guardian assumes full responsibility for the account. You agree to provide accurate information when creating an account or a campaign.

3. Non-discrimination

Wenkendi is open to users regardless of race, color, national origin, ethnicity, religion, sex, gender identity, sexual orientation, age, disability, marital status, veteran status, or any other characteristic protected by applicable law. We do not tolerate discrimination, harassment, or hate speech directed at individuals or groups on the basis of a protected characteristic. Violations may result in account suspension or termination. All users remain subject to the eligibility requirements and platform policies set forth in these Terms.

4. Campaigns and content

Users are solely responsible for the content of their campaigns, including descriptions, images, updates, videos, and the use of any funds received. Wenkendi does not verify or endorse campaign claims and provides no guarantee that funds will be used as described.

All uploaded videos are subject to the Wenkendi Community Guidelines and may be reviewed, hidden, or removed at Wenkendi's sole discretion.

5. Prohibited activities

  • No fraud, scams, or deceptive activities
  • No money laundering or terrorist financing
  • No illegal fundraising
  • No hate speech, harassment, or harmful content
  • No impersonation of individuals, companies, charities, or organizations
  • No infringement of intellectual property or privacy rights

6. Platform fees

Creating a fundraiser is free. Wenkendi charges a 5% platform fee on successful donations to support platform operations, hosting, security, customer support, compliance, maintenance, and growth. Standard payment processing fees (approximately 2.9% + $0.30 per transaction) are charged separately by our payment partner.

7. Donations, refunds & chargebacks

All donations are voluntary and are generally considered final. Unless explicitly stated by the campaign organizer and permitted by law, donations are not refundable and may not be tax-deductible. Donors should review each campaign carefully before contributing.

Refund requests and payment disputes may be reviewed on a case-by-case basis at Wenkendi's sole discretion. Wenkendi reserves the right to investigate chargebacks, reversals, and fraudulent payment activity, to share information with our payment partner and card networks as needed, and to suspend accounts associated with abusive chargeback behavior.

8. Intellectual property

Users retain ownership of their original content but grant Wenkendi a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content for the purpose of operating the platform. Users may not upload material they do not have the right to share. 9. Anti-fraud, AML & compliance

Wenkendi reserves the right to review, suspend, remove, investigate, or report campaigns, accounts, or transactions that appear fraudulent, misleading, deceptive, unlawful, or harmful. Wenkendi may monitor transactions for signs of money laundering, terrorist financing, sanctions violations, or other illegal activity, and may cooperate with law enforcement, tax authorities, and regulators when required by law or when Wenkendi reasonably believes disclosure is necessary to protect the platform, its users, or the public.

10. Account suspension

Wenkendi may, at its sole discretion, suspend, remove, review, or investigate accounts or campaigns that appear to violate these terms or applicable law, with or without prior notice. Funds associated with suspended campaigns may be held, refunded to donors, or returned to source as appropriate.

11. Limitation of liability

To the maximum extent permitted by law, Wenkendi, its owners, operators, employees, contractors, and affiliates shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the platform.

12. Payouts & holding period

Donations are collected immediately at checkout but are notimmediately available for withdrawal. Funds are held for 14 daysafter each donation is received. After the 14-day review period, eligible funds become available net of Wenkendi's 5% platform fee and standard payment processing fees.

The minimum withdrawal amount is $25. Wenkendi may require identity verification before releasing funds and may place additional holds for security reviews, fraud investigations, chargebacks, suspicious activity, legal requests, or compliance requirements. Wenkendi reserves the right to delay, suspend, deny, or reverse payouts when necessary to protect donors, beneficiaries, the platform, or to comply with applicable laws. 13. Fraud Prevention Policy

Fundraisers must provide truthful and accurate information. Creating misleading, deceptive, or fraudulent fundraisers is strictly prohibited.

Wenkendi reserves the right to suspend, review, remove, or permanently ban accounts suspected of fraud, abuse, or misrepresentation. Wenkendi may request additional documentation to verify fundraiser legitimacy.

Donations may be held, delayed, or refunded if fraud is suspected. Users are responsible for ensuring all information submitted is accurate and lawful.

14. Fundraiser Duration Policy

Fundraisers may be created for 14, 30, or 60 days. Fundraisers automatically close when the selected duration expires.

Expired fundraisers cannot receive new donations. Closed fundraisers remain visible for transparency and recordkeeping. Users requiring additional funding must create a new fundraiser.

15. Identity Verification Policy

Identity verification is required before withdrawals. Wenkendi may require government-issued identification and supporting documentation.

Failure to complete verification may delay or prevent withdrawals. Verification information is used solely for platform security, fraud prevention, and compliance purposes.

16. Terms of Service Protections

Wenkendi acts solely as a technology platform connecting fundraiser creators and donors. Wenkendi does not guarantee the success, accuracy, or outcome of any fundraiser.

Donors are responsible for evaluating fundraisers before donating. Fundraiser creators are solely responsible for the use of donated funds.

Wenkendi reserves the right to investigate suspicious activity and cooperate with lawful requests from regulatory or law enforcement authorities. Users agree not to misuse, abuse, manipulate, or attempt to circumvent platform policies.

17. Administrative Rights

Wenkendi reserves the right to suspend, restrict, remove, or terminate accounts that violate platform policies.

Wenkendi may remove content that is unlawful, deceptive, abusive, harmful, or fraudulent. Administrative decisions regarding fraud investigations, platform security, and compliance may be made to protect donors, fundraiser creators, and the platform.

18. Deceased fundraiser owner

If a fundraiser owner dies before withdrawing available funds, Wenkendi will hold the account and any unpaid balance. Funds will not be automatically released to another person, including co-organizers, listed beneficiaries, or family members. Once Wenkendi receives verified notice of death, a 120-day claim period begins, during which a verified estate representative, executor, administrator, or other legally authorized claimant may submit documentation and request release of funds. Acceptable proof may include a certified death certificate, letters testamentary or letters of administration, a court order, a small-estate affidavit where permitted by law, or other legal estate documentation, together with government-issued identification of the representative and any documentation required by our payment partner. If no valid claim is received within 120 days, funds are not automatically released and are not automatically transferred to Wenkendi; the account is flagged for legal review and any remaining balance is handled in accordance with applicable laws and regulations (including any unclaimed-property obligations), our payment partner's payout requirements, and any court or governmental direction. 19. Changes

We may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
